Dark Day In Phoenix - Arias Remains Unsentenced

I am still shaking my head in disbelief this morning, following yesterday's "non-verdict" in the sentencing phase of the Jodi Arias murder trial.  Disappointment, shock and heartache were on the faces of each and every one of Travis Alexander's family members and friends as the decision was read in court yesterday.  I can't express how badly I feel for that family. After losing their beloved brother to a vicious and senseless murder, they sacrificed the last 5 months of their life away from their homes, their jobs and their lives - to be sure Travis' death did not go unpunished.  Sure, Jodi Arias was convicted of first degree murder with an aggravating factor, but this nightmare will not be over until Arias has been sentenced.

For the rest of us who have been following this story since 2008 and have watched this trial as it unfolded, it's disappointing and frustrating that justice has once again been delayed!  I just looked back at my first few posts for this blog, back in November and December of last year and it reminded me of how many delays there were in this trial - even in the jury selection process. I have so many questions on how this will play out.  Will Jennifer Willmott & Kirk Nurmi be allowed to now withdraw from the case? I thought I heard they were remaining on to see the case through, but I'm not certain.  With Arias criticizing them publicly after the work they have put in for her, I can't say I blame them.  They had a difficult job with a even more difficult client. I don't agree with their distasteful trial tactics but they did their jobs. 

If they were allowed to withdraw or if Arias were to get new representation, can you imagine how long this could be delayed? If anybody knows for certain if Willmott/Nurmi are staying on the case, could you please post the info? If they remain as attorneys of record that should speed up the process in empaneling a new jury.  I have no idea what the rules are around the voir dire process, or what Juan Martinez needs to do in order to get the best death qualified jury he can.  I don't understand how this jury became so splintered (reportedly 8-4 in favor of death), after agreeing on guilt and aggravating circumstances.  I don't know how they viewed the jury instructions, they seemed long and over-complicated to me. Is it possible there were jurors on the panel who could not hand down a death sentence to a female regardless of how they answered their jury questionnaires?

Murder is an equal opportunity crime, however it seems that juries have a harder time sentencing women to death than men. I don't know what the jury went through during their deliberations, however the jury foreman spoke to my new favorite reporter, Ryan Owen - he told Owen there was a significant split on sentencing from the start.  He also said he thought Jodi Arias made a poor witness and she didn't do herself any favors by being on the stand for 18 days.  I wonder how these jurors are going to feel once they have seen how this woman has been conducting herself during the trial, during their deliberations?  Will they feel duped, scammed, played? Would it have made a difference if they had seen the real Jodi Arias before sentencing? I think it would have gone a long way towards showing the arrogance and self-centered Arias has no real remorse for what she did. When she talks about this being "the worst thing she's ever done", that's about the closest she came to taking any responsibility for the lives that she's ruined.

I don't know what to say at this point! I don't think Sheriff Joe is going to  to allow Arias' media tour to continue - that would be a good start. At least Arias is now in a single cell situation,  no more dormatory-style setting with other inmates to hang out with. The Alexander siblings are expected to file a wrongful death suit against Arias, I hope the sentencing delay doesn't interfere with anything they have pending. I suppose now that she's been convicted of murder, they could proceed whenever they wanted but clearly this is their first priority.

  1. I have a very strong belief that there is lookism and gender-bias that affected their decision. The foreman even said he couldn't believe she was capable of the crime when he first saw her. And yes I agree My Forte, a man commiting the exact same actions, from all the obsessive, stalking behaviors leading up to and including the actual murder, would have already been convicted and given the death penalty, IMO. I have said before, not enough has been said about lookism or sexism in this trial. If JA had been older and unnatractive I think that would have definitely made a difference. I am also wondering the gender-bias if the men felt a need to protect or maybe the women felt maternal, it's interesting the vote was 4/8, same as the female/male split. I wonder if the 4 were a majority male or female or if it was just an even mix. The foreman also said he believed she was the victim of verbal and emotional abuse. GRRR. First of all, he didn't say physical. Second of all, as far as TA being the abuser we are again dealing with some gender-bias. Men do not deal with abuse and stalking behavior the same way as women do, period. They don't feel like they are in grave danger typically the same way as a woman. Men tend to feel like maybe she's a little crazy but I can handle it. On top of that TA came from some dysfunction so her actions probably didn't fully register with him as a red flag. And because of his dysfunctional upbringing he seemed to develop the "saviour" type personality. There are several types of personalities that typically come from this kind of background and I believe the "saviour" was what TA was. His wanting to protect his siblings, deep gratitude in life and wanting to help and encourage others are why I believe this. I feel sure he felt empathy for JA and wanted to help her in some way as well. So instead of ALV using this opportunity to bring awareness of the ways men can be abused she muddied the waters and left people to believe the typical societal gender-bias. Most of you know that I was the victim of serious dom violence and that I now know that I had suffered from BWS. I can tell you that during the many, many horrible abuses I suffered that sometimes I would react rather than cower. And if those reactions of mine were to be taken out of context it would look really bad. Poor Travis! All she did is take his reactions out of context and it was able to sway the jury at least to some extent. I truly believe that JA was abusive to Travis and this is dom. violence that escalated to murder, just that it happened to a man. JA became obsessed, sexually manipulated him, stalked him, broke into his accounts, wrote threating e-mails, slashed his tires, on and on, and then murdered him in truly heinous and cold-blood after having sex with him. A man or unnattractive female would have been crucified. JA was also different as an abuser because she is a female. I am certain that all of her abuse to Travis was in the gas-lighting, passive-agressive manner, but make no mistake AGRESSIVE manner. In her fake overly-feminine, controlled and passive-agressive way I am sure that she was driving him crazy with her circular logic, fake apologies, composed lies and denials. JM hit the nail on the head when he said at that final text that TA had, had enough! That is exactly what was happening and they took his comments out of context!

  2. Groundhog Day is one of my all time favorite movies. It's funny Dave Hall would make reference to it. But here is my take away from the reference. Bill Murray sees Andy McDowell and falls in love with her at first sight. They are destined to be together but he is not the man he should be. He repeats Groundhog Day over and over until he becomes the best of himself. Once he becomes the man he should be Andy McDowell falls in love with him too and they go to their destiny together. So as far as this trial going on and on like Groundhog Day, I think maybe it's just what needs to happen for the justice system to get it right... JA is not going to have the opportunity to sway this next jury the same way and I think they are going to be able to be more objective and get it right.

  3. Gaslight!!! One of the BEST films ever! Yes to everything you wrote here. Listening to Jodi verbally spar with JM, that's what Travis went through. I was married to someone who loved to push my buttons, we fought and yelled and screamed like there was no tomorrow. It's not my nature to be that way, I've been away from him for over a decade now and my marriage now is so calm and peaceful, we don't yell or name call. But my ex enjoyed pushing my buttons, it made him feel like I cared for him. I think Jodi pushed Travis' buttons big time. When he responded in anger, in her warped mind she took that to mean he still cared.

    I SO agree with you that Travis didn't feel physically threatened by Jodi. She did some scary things and I think he was probably more afraid for the females he was involved with than for himself. I don't think he ever, in his worst nightmare, would've have predicted being stabbed to death by a woman.

    4. Sue - I'm a movie person and I like the underlying meanings and like to get references that most people miss. Listen to the how Andy McDowell describes her perfect man... I have seen it many, many times. There is some debate about how long he repeats the day... one year? a thousand? The same director did Bedazzled which is very cute and has an underlying message :)

    5. Gaslight's an old movie Alice, from the 40's I believe. Ingrid Bergman is emotionally tortured by her husband, he drives her to believe she's going insane. It's a wonderful movie.

      I had recently watched a black and white movie called "Whatever Happened to Baby Jane", solely because I have heard it referenced on gossip sites over the years, and became very curious about it.
      (It was really good and certainly one I'll never forget.)
      I think I'll really like this Gaslight you described because crime/psychology stuff really interests me (as it seems to all of us posters here at the aptly- named MyCrimeTime!)

  4. Arias duped the jury as she did all in her life. A good sociopath she is. I feel the jury will be in a bad way once they see & read all-about-Jodi that they were not privy to. That said, although "you never know with a jury," it appeared all in this trial pointed to death penalty. Particularly upsetting is the jury foreman. He admitted he was shocked day 1 when he saw her. How could she be a killer? It is obvious he was biased favorably towards Arias from the beginning of the trial. Meaning, his hormones. So the seductress continues, trying with the men she comes across. This foreman should have been kicked off the jury or had the honor to withdraw for the sake of justice. I also think he has some forceful personality clout within the jury.

    1. I really want to get all the jurors in a room and show them everything they don't know about! The forged pedophile letters that JA's mom tried to sell to the Enquirer! The purely foul jodiariasisinnocent site including Travis in a body bag stating justice had been served! Her nearly six hours of interviews and demands of make-up and her reaction to any tough questions! All of her horrible stalking and abusive behaviors that couldn't be entered as evidence because it was heresay! And then I want to see what they say about having any sympathy for her.

      I was thinking the same thing about the jury foreman.
      If you are judging (in this case favourably) someone based on their looks than you are being biased.
      I was really disappointed at his comments when he said that looking at her, he couldn't believe she would be capable of such a heinous crime.
      What does her looks have to do with it?
      Anyways... what about her smirking, smug expressions throughout the trial?
      Shouldn't that have over-ruled her nature-given looks that a person can neither help nor earn?

  5. This jury foreman disgusts me...first of all i am a white male...if Jodi was a man..or older..or dare I say black...she would have been given death..this foreman was biased on this monsters behalf..sorry..just how I feel..

    1. I completely agree, Anon 2:28. Sadly I have been thinking the same thing. If JA was a black male the trial probably wouldn't have lasted a week and it would have ended with the DP.

    2. I agree as well Anony (2:28} Men don't fare too well in these things...not average income men anyway. And women with a bit of age and diminishing looks don't do too well either. I could be very wrong on both counts. I only state my personal opinions and thoughts...it doesn't mean I am right. Anyway, I feel there are many ppl sitting in prison that weren't so blessed with appealing looks. I kinda thought bias would enter into this case due to bombarding the jury with all the 'blonde bombshell' images. Then the first 2 verdicts came in! Wow, I said to myself! Now the penalty phase verdict is another kinda WOW. I just don't understand in view of the first 2 verdicts being what they were. I am not saying it HAD to be death...but NO verdict isn't acceptable given the other 2 verdicts. It leaves many of us to wonder, doesn't it?

  7. Hello to all. I am new-I've never posted on a blog in my life until now, but I ran across this several weeks ago and haven't stopped reading for a day or night since. My Forte, you and all of you express my thoughts and feelings of angst and frustration perfectly. I even laugh at times, which is a good thing. Always I feel like I am reading my own mind and heart on this vile, hideous 'subject' which is now known to us all as "JA"!

    I wish I could predict how this will all turn out. But, I can't. Since OJ, and then again with CA, I don't have any faith in jurors. I am, however, pleased this jury did find M1- Premeditated, with the aggravator. But, I also feel due to those findings a few perhaps weren't totally honest during voir dire concerning the 'death' question. Although, it is a deeply personal decision within one's own heart, I can't help but feel "they knew this was a DP case from the get-go." But then, I am not much of a 'gray area' person, so that's me. I suppose I am sick of these 'types' getting out of either conviction or DP, and I hope one day there will be a whole new precedence set. Afterall, when a defense case is built upon lie after lie, it takes this kind of thing to a whole new level. Which is why ppl are so angry. IMO this character is actually no better than a serial murderer when I think of the many ways she killed this young man and his family as well in terms of the continued torment, of not only having brutally slaughtered their brother, but of all the character assassination piled on top of that... And she walked right out and left him there after stuffing his brutalized body in a cold, damp shower. Oh oh...that's right...the 'fog' rolled in. How perfectly convenient...and the jury seemingly 'fogged out' too!

    Anyway I love your take esp now cos I have to admit it has taken me a couple of days to know wtf just happened.

    1. Hi wastrel! I'm sure yesterday's hung 'no verdict' was quite the win for JA and the defense. But, it's a temporary reprieve at best.

      I am wondering if round 2 of this penalty phase will happen due to budget reasons. Afterall, it was for that reason the jury wasn't sequestered. Monetary costs may dictate here, but I feel sure Jaun M. would like to go for it. Unfortunately, he has to answer to someone higher.

      Who knows why JA was crying. Probably satisfaction that she had at least duped some of the jury anyway into this temporary limbo state. But, honesty, I feel there is going to be some major twist...shift. But, I don't know what it will be. I just have a nagging, sinking kinda feeling. I hope I am wrong.

    2. Nancy - I agree completely! That thinking is in line with the people who insist that the jury should have been sequestered. So the attorney's can make a vow to protect their client, the witnesses can vow to tell the truth (inc JA), but the jury isn't to be trusted to not watch TV or discuss the case? This certainly would have been an appeal issue if they had been sequestered in the middle, almost admitting they were tainted and not telling the truth.

      The foreman view seems so biased! Of course it's supposed to be regular, un-jaded citizens! In Florida, the majority rules and it would have been DP! The jury doesn't have to be unanimous! AZ has the extra protection of unanimity. Jerk. I wonder how he would feel if it was his son...

    1. Thanks much for these links NancyB. I just saw this foreman man's video clip. It really made no sense to me. Afterall, some verdict could have been reached despite the 'why' question. She still brutally murdered TA. It kinda feels like he is hoping 'no verdict' will exonerate her of any culpability. As if the question of 'why' she did it wipes away any responsibility on their part and hers. To me, this was a very 'common-sense' trial, simply because it was certainly the most transparent one I have ever seen. I could go into all of my reasoning I feel this way, but first and foremost was the use of TWO deadly weapons so conveniently at her disposal to murder him. That alone simply doesn't scream self-defense to me. Of course, there are many more reasons, based on the evidence presented, not to mention the myriad of lies caught dead to rights, as to why this is so blatantly what it was...a ragingly vengeful, pre-thought-out, jealousy-driven butchering. I also don't believe TA abused JA. I realize there were some ugly words spoken by him, but one may ask themselves 'WHY' he did that! Well, actually, I don't wonder...she was a wee button pusher to the enth degree. And she is still pushing buttons! I don't even label her with any of the psych terms either, unless EVIL is a psych label. Furthermore, I don't believe she was abused by her Mother either! A wooden spoon...give me a flippin break! Many children should be so lucky. I don't buy any of this whole ACT...nor do I think I am all alone in that thinking. I am outraged, so I can't even begin to imagine what hell his family has gone through, and continues to go through. God Bless them all mightily. I feel such a huge hole in my heart for them in the last 24 plus hours. Imagine theirs!

      *Oh..someone please explain to me why, if abuse (DV) was at the basis and foundation of this trial, does one move more than 1,000 miles away from such an abuser, and then go back for more..historically speaking, knowing there is a very real probability of MORE? Was that fear of the abuser? I realize when people are IN a situation it can be difficult to get out of for various reasons..BUT, this was not the case here...???*

    2. M Bethnae - i don't call this a rant, but rather logical reason that I just wish this narcissist foreman had a bit more of.

      The more I hear this guy talk the more I think he’s a transplant from Florida! He made the media statement that JA was “Crucified in the court of public opinion”. (RadarOnline). The judge released him from his admonition late on Thursday afternoon and he immediately began his media booking blitz. Hours later followed by his whirlwind media blitz. In less than 24 hours how did he scope out the previous 5 months of the trial to ‘educate’ himself on what public opinion is? Amazing, since he was observed daily throughout the entire trial and rarely wrote any notes down on that most all important aspect of his sworn obligations.

      Zervakos then said:
      "I tried to keep my feelings as neutral as possible," he admitted.
      But his feelings on Juan Martinez are not as neutral.
      "He's merciless," Zervakos said of the lead prosceutor on the case. "I don't like being talked to like I'm stupid and I feel like that happened a few times."

      The defence team tried to assume the jury was incredibly stupid, as judged by their ridiculous domestic violence claims.
      Also... they foreman is trying to critisize Juan for being "merciless"????
      Where is his criticism for the defence attornies who were basically unethical and embarassingly inept (for example Willmot's cringe-worthy cross-exam of Dr Demarte, where she tried to emulate Martinez and failed laughably), as well as defence withness ALV who slandered Travis and lied on the stand.
      Which team behaved worse?

    What??!! And I'd like to know why is he speaking for the entire jury? I’ve heard bits and pieces of him saying, we, we, we. I think something is very faulty here.

    1. Excuse me?? This foreman man wants to talk to JA? Who does that or thinks that way after they have been dismissed from a trial. Something is just wrong-headed about that! No wonder it all went awry yesterday! OK...his 15 minutes are up now!

      If the penalty phase does continue to round 2, I don't hold out much hope in the next selection either. There always seems to be at least one with odd-ball, ulterior motives from the off. You just never know what will be lurking in a jury. Geesh...so much for the sanctity of the system. Something is amiss with him. Very creepy IMO.

  15. Also, the jury foreman said that he was influenced by the fact that Travis had verbally and emotionally abused Jodi. This really only occurred in the final IM to Jodi on May 26 when Travis said that she had betrayed him, scammed him, and was a whore/slut. First of all, this was one message, which does not equal overall abuse. But how can Juan get around this charge in the upcoming penalty retrial? We need to know why Travis suddenly became so overtly hateful on May 26. I agree with the popular theory that on this date, Jodi played the sex tape for Travis as a threat or as blackmail, and he went ballistic. I wish Juan could find out the truth behind this matter to show that Jodi was the cause of Travis' only full-on meltdown. I assume this would be impossible, so hopefully Juan can introduce some new evidence that was previously rejected or was unavailable.

    1. I agree Cindy that that would be valuable info for Juan. I do not believe at all that the recorded sex tape was previously agreed on between the two of them. I always believed she did it unbeknownst to him for her to use on him, which is what I believe she ultimately did to set him off that one KNOWN time..the reason behind such an out of character outburst from him. However, Miss "Evil A" is the only one who knows now!

      Exactly! Unfortunately, the victim was slaughtered by this master manipulator. I'm sooo pissed that *many* of her LIES have been successful.

      There were 85,000 Text messages in this case. On 3 at the MOST 4 occasions ONLY, Travis used "bad" language - 3 hole wonder, LIAR, sociopath, worst thing that ever happened to him blah blah blah. Even Chris & Sky Hughes can't figure out what truly happened on May 26th but one thing is for SURE - he was totally done with her. My personal belief is that she told him that she was going to send Mimi Hall, the Bishop and all of his friends emails claiming he was a pedophile along with playing the SEX tape that HE never knew she saved. No proof, just what I think.

    3. I agree NancyB. But, then I believe anything and everything she says are "designer lies!" Thankfully, she made a few mistakes enough to get her to Murder 1-Premeditated with an aggravated factor. But, it continues to baffle me that the jurors could get there yet unable to render any verdict at all. As, I don't consider a 'non-verdict' a verdict. Did they forget among her many lies, she sat there and lied to them too, as did the defense witnesses. In fact, the entire case was just that..a lie. After I had given up that many months of my life it would have been like pissing down my leg and telling me it's raining. Very offensive. But, it would do far more than offend me...it would squarely place me back into my belief system of using simple little common sense "life tools" as I call them, in order to gauge people I have to deal with. One big one is "once someone shows you who they are...Believe them." The other is, "if you want to know a horse, look at it's track record."______

      Which brings me something else entirely...the foreman stated..."she had a perfectly normal life prior to TA. Well, I don't believe that at all. I believe she 'played a role' with everyone she met. Poor Mr. Brewer...I believe he didn't even know who she was or what he was dealing with at that time in his life, because she played a very careful role with him. Just my belief. What her life turned into after she met TA was already there... building, building, building. And it was never gotten into check obviously along the way. But, there were signs. I know there had to have been. Had it not been TA she did this to, it would have been someone else. It was what it was, and she was who she was, deeply rooted deadness. There is no pill for this. No combination of pills. No therapy either if she refuses to ever come clean. And it's clear to me she knows she lies because she carefully plans and tailors them to whatever circumstance needed..to whoever she is faced with. In other words, on a very well clarified level she is acutely aware of what is working for her. She knows she lies and she is not willing to stop. It all comes down to her Will. It is not even bridled now because of incarceration...yet the behavior continues. And it runs the gamut... all the veiled verbal stabs...subtly lashing out, placing blame, manipulation, turning on that fatal charm which is also tied into her sexuality...THE PERPETUAL ACT...and lying continues. It all takes much thought, and carefully laid out plans. Hence this is why even the professionals continually get sucked in. The gig isn't up for her yet. But, for now, she isn't on the streets...

      Just my thoughts and belief...

    The U.S. Court of Appeals for the Ninth Circuit just ordered Denying the State of Arizona’s petition for a Rehearing En Banc. View and download the order at http://debmi.me/orderdenyrehh.

    The question now is whether or not the State of Arizona will file a Petition of Cert at the SCofUS but with no interest from any of the Appeal judges it does not seem very likely. That would mean the case next goes to the County prosecutor Bill Montgomery who has to decide within four weeks whether to retry Debra. But how should he do that? We can start calculating the release date, I guess.

    There has been lots of activity at Perryville lately. It appears it is preparation for Jodie Arias who was convicted of first degree murder last week and whose trial was covered nationwide. She also appeared on segments of ’48 Hours’ and ‘Dateline’ and everything about her has been the headline news here in Phoenix. Since the penalty segment of her trial was postponed until this week the local media are scratching for news to fill in the gap so there has been a lot of stories about ‘what life is like on death row’ and related subjects.

    Got a wonderful call from Debra this morning, and she was in great spirits. It has been a big week for her with lots of things going on but as of today things are shaping up nicely.
    Her concern last week of privileges being taken away and crackdown on policies and procedures is now clear. The Perryville prison was getting their annual ‘audit’ (like an IG inspection) so of course they had to play by the rules so they didn’t get write ups. That may still be going on but everyone knows why know and after they leave I am sure some of the special things will be restored.

    She had her periodic conference with the warden on Wednesday. The warden has been very good to her and is a great gal and warden. She treats inmates fairly and equally. Anyway, she said they had a good talk and answered some questions for her. She will give me more details when I visit on Monday.

    The mandate came down from the 9th CC this week and that is the document the attorneys are waiting for to start moving things along. This document officially vacates Debra’s conviction and sentence. But it also requires other items to be met by the court order so nothing will change for Debra until they are completed. (…)

    We covered lots of subjects and Debra was in good spirits. The audit is still going on so there were lots of ‘suits’ in the area but nothing unusual occurred. Shawna Forde also had visitors for a period of the time but it did not interfere with anything.

    The major issue for her and her neighbors right now is a recent decision by the DOC Director as a corrective action from a recent death up at Florence. A death row inmate committed suicide up there so the Directors corrective action of “overkill” was to have all the doors on death row rooms be modified from one small piece of glass to almost all glass. Of course they are not allowed to cover up anything so now they are totally visible 24/7. There would be absolutely no privacy even when using the commode or changing clothes so you see the problem but the change will ‘protect’ them better. Since almost all CO’s (correctional officers) are men in that area you can see what their concern is. Anyone and everyone can look into their room at anytime. The first door has been removed and is being modified. It will be Jodi Arias room if when she arrives. Jodi has declared suicidal tendencies so she would be on watch at first. This is pretty standard procedure so that is not new.

    A local supporter got a call yesterday:

    DEBRA CALLED.

    “I got a call from a very frustrated Debra. She needed to vent and that she did! She wants out and NOW! Very understandable as things have tightened down again out there and she is not a happy person. The phone calls between her and her mom are now cancelled. No more! Fini! The door to her room has been modified and it has only the upper half in glass. They did not put a lower panel in the door so they will have some privacy.

    The staff seems to be psyched about Jodie Arias coming. Her room is ready (next to Wendi Andriano but with a wall and no vent between them) and will be on suicide watch indefinitely. The jury on her sentencing phase was ‘hung’ earlier in the day and were sent back to try and break the deadlock so we don’t know what the final answer is yet. They say she will be immediately transported to Perryville upon receiving her sentence so everyone seems to be getting ready. With the audit still in work I am sure things are a little ‘sticky’ out there for everyone.

  21. I just listened to Inside Edition and I am soooo confused listening to this man.

    Jody is innocent until proven guilty — WTF is he talking about? She ADMITTED that she did it in her testimony.

    He claims that “she was a 100% “normal” young lady prior to Travis” —Ohhh who does that sound like? I think that he listened to Darryl’s interview. I really do. Was he ASLEEP during the prosecution’s case?

    The 15 y/o JA so pissed over being grounded for staying out all night that she quits school and moves in to a shack with a boyfriend. The one that kicks dogs. The one that goes after her brother with a baseball bat. The one that travels a hundred miles to confront Matt McCartney’s new girlfriend. The one that gets boob jobs while her house is going into foreclosure. Is that the normal young lady that he’s talking about? The one that ALV says that punches holes in walls& breaks down doors. Ohhhh.

    This man is NOT normal at all. Not sure what deranged planet this cueball is from. Please will one of the other 8 talk now and put this man on blast. I would be livid if I was on a jury with him and he caused me to not be able to render the ONLY just verdict that the law calls for and the court had ALREADY PROVEN.

    Juan is soooooo lucky he got FIRST degree murder out of this jury. The way this guy is talking he reminds me of a dirty old man who has a thing for Jodi, i don’t know how he agreed to convict her of first degree murder. Thank God they did that part RIGHT!!!!!

    What? Who does this guy think he is? If Det Flores couldn’t break her he thinks that he can? This man is a full blooming idiot.

    “Now the penalty phase will have to be done all over again with another jury”. Bill Zevakos says finding another impartial jury will be almost impossible.
    “I just think it’s going to be brutally difficult and quite frankly i don’t think it’s fair.”

    LOLOLOLOL What does he mean about finding ANOTHER impartial jury? He was anything but an impartial juror!

    He has the nerve to complain about the way JA’s been treated! Really? That she’s been crucified in the court of public opinion. I can’t stand to listen to this tripe.

  22. She may have duped 4 jurors, but 8 clearly wanted her as dead as I/(we) do.

    What bothers me the MOST about this trial, is not the penalty phase mistrial. What makes me ENRAGED, is that a DEAD MAN was put on trial! The worst thing a human being can be wrongly accused of is (IMO) is a pedophile! The fact that it was EVER ALLOWED to come into trial without evidence is SO WRONG! It was allowed to be submitted in a court of law, because he said on a (blackmail) audio, “You sound like a 12 year old girl having her 1st orgasm”- WTF? Make up your mind Jodi, does he like little girls, or little under-roo clad boys? Pedophiles are not known to have preferences for both sexes. So yes, this is a DANGEROUS precedent!

    She will know she LOST, after one week in Perryville.

    1. Correct Nancy. Pedophiles don't go both ways. Also, Jody knew it was illegal to record someone without them knowing it...so, of course, she says it had been talked about and mutually agreed upon previously that their sex convos would be recorded. Again, absolutely now proof of that lil tidbit. Sad that TA said that and how easily it was turned against him...the real victim here...the one that is dead...murdered.

      As for this jury foreman..he talks outta both sides of his mouth actually. He stated that he was speaking on behalf of all of the jurors...funny that some wanted 'DP' isn't it? Something is not right with the whole thing...and with this man...and I feel like it's gonna come out sooner or later. Perhaps another juror will speak out in time. I hope this foreman goes and visits Jody and perhaps he'll get sucked into the vortex. She destroys, lays waste to everything she breathes on or looks at. It's like an invasion of aliens(ari-ass)!!

  24. As you walk into deliberations, the first thing you do besides look at eachother and think, wow, this is for real, is decide on a foreperson. This person isn't necessarily the smartest in the room (as appears to be the case here), but the person with confidence and leadership skills. After hearing/reading some of his comments I'm trying to figure out how they decided on premeditated 1st degree murder. All the evidence shows this but there is the human factor that is not evidence but will always have some say in the matter. After a few days of deliberations, deciding on the 1st degree, we get to the aggravating factor. 1+ hours later and we have the only possible answer to this question. Now the penalty phase. Last I checked gender wasn't a mitigating factor? Sounding like a victim, nope in fact evidence shows otherwise. Not having the looks of a psycho killer (whatever this may be), nope. If you are going to spend the rest of your life in prison, what can you possibly offer the world? Nothing. What can you offer the prison world? Who cares? For me, JM is part of the reason that they were not able to resolve the penalty phase. He needed to emphasize that she may look like your neighbour, she may sound like an innocent human being, she may be articulate but they convicted her of a horrendous crime. He didn't do this. He focused solely and to a certain extent correctly on Travis. This cost him. I'm not really sure if he is allowed to say things that I mentioned but I would think that at the least he could have expressed the fact that although she may not look like a killer, she committed a horrendous crime that the jury agreed was 1st degree premeditated murder.

    Deciding that another human being has committed a crime such as 1st degree murder is not an easy thing. You tend to feel too much pressure, too much responsibility is put on you. Their is a God factor that we are not able to cope with. You must detach yourself from it all and realize that you are doing a job. You must obey the instructions that are given to you by the judge and if you do so, you will be fine with your decision. It will still be very much an emotional moment, again too much power for little ole me. For the death penalty I would assume that this is magnified 1000 times over but again, you are not the one who committed the crime, you are not the one who will put her to death. I don't understand how they were able to be unanimous on 1st degree, then the aggravating factor but not the penalty. They did not follow their instructions.

    Going forward, maybe the next jury will have the courage to sentence her to the death penalty? Either way I don't think she will ever face the needle. I believe the Arizona system has passed a Supreme Court challenge but how can someone be sentenced to death by a jury who never convicted her of 1st degree murder? Makes no sense. I hope she dissappears off the face of the earth, is beaten on a regular basis (then she will be an abuse victim) and is surrounded by those pictures in her cell and dreams.

Hi Anony (12:06) I had the feeling as I was listening to JM on that final day that he was trying to bring TA's humanity back into the courtroom since he had been so thoroughly trashed throughout the trial. He did that for Travis's family too I think. I do wish there had been more pounding the fact in that they had convicted her already of 1st Degree Premeditated Murder and that it was heinously carried out with no mercy.JM had plenty to work with in terms of what was already entered into the trial. However, in view of this last penalty phase verdict, and something so obviously being 'off' and seriously questionable with that, I feel rather strongly that nothing would have mattered and made no difference in the outcome. This foreman man had his mind made up! And for whatever reason he had...he was pulling for Ariasssss. IMO.

      I agree that if she gets DP, IF there is round 2, she more than likely won't get the needle. I have learned 68% DP sentances are over-turned on appeals. That's a pretty high percentage...and with her particular skillset...she very possibly can pull a rabbit outta da hat! Oh, oh..we all just want her to go away! This is SAD and INFURIATING...

    2. M. Bethnae, I agree with your previous comment that it's very unlikely that a jury which has not heard the entire case would vote for the DP. Even though I was obsessed with this case, I now feel kind of burnt out and really just disgusted by the fact that Jodi successfully, masterfully lied and will forevermore conceal the true facts of the case. I'm ready for her to be sent away w/out parole, never to be heard from again. As I previously said, I wish there were some additional evidence Juan could bring into the new penalty phase.
