Dr. Janeen DeMarte - A Look At The Prosecution's Expert Witness

Dr. Janeen DeMarte is expected to take the stand in the Jodi Arias murder trial as a key witness for the prosecution. Think of DeMarte as the State's response to Dr. Richard Samuels and potentially Alyce LaViolette. It's unclear when DeMarte will testify, but with Alyce LaViolette's testimony wrapping up, I thought it would be helpful to take a look at who the State's expert witness is.

Dr. Janeen DeMarte is a licensed clinical psychologist who has a private practice in the Phoenix area. She holds a master's degree and PhD in clinical psychology. with a concentration on forensics - and graduated from Michigan State University and fulfilled her doctoral residency at Arizona State Hospital.  Her clinical training was done at outpatient clinics, correctional facilities and inpatient unit settings. She has served as the Clinical Director of a large outpatient behavior health clinic in Phoenix and "oversaw the practice of numerous multidisciplinary treatment providers", according to "sentiencepsych.com". Dr. Demarte has developed a highly regarded program for practicum students of Arizona State University, Argosy University, and several other academic institutions.

She has also instructed bachelor students at the university level and provided training for master's and doctoral students in the field of clinical psychology. I found information on DeMarte on sentiencepsych.com, which is the website for "Sentience Psychological Services LLC", this is DeMarte's practice. Some of the services provided through Sentience are listed as:

  • Therapy
  • Psychological Evaluations, including:
    • Personality Assessment
    • Intelligence & Cognitive Testing
    • Capacity Evaluations
    • Forensic Evaluations
  • Lectures
  • Expert Testimony
  • Consultation & Supervision

Psychology Today lists some of the issues DeMarte deals with:

- Anger Management
- Behavioral Issues
- Depression
- Domestic Violence
- Obsessive-Compulsive Disorder (OCD)
- Sexual Addiction
- Teen Violence
- Antisocial Personality
- Borderline Personality
- Narcissistic Personality
- Domestic Abuse
- Sexual Abuse
- Oppositional Defiance
- Suicidal Ideation
- Bipolar Disorder
- Psychosis

I'd expect Juan Martinez to quickly point out that DeMarte is qualified to conduct the testing on Jodi Arias that LaViolette wasn't. Both Samuels and LaViolette have more years in their fields than DeMarte does, but the jury may find this fact refreshing.

LaViolette does not have the licensing or education required to conduct testing, she can only read other people's tests and apply her own interpretations. I'm not saying LaViolette is not qualified in the area of domestic abuse, I'm simply stating that Dr. DeMarte holds higher educational degrees. Of the "issues" list above, I'd be interested to hear if DeMarte looked at the areas of sexual addiction, antisocial, borderline AND narcissistic personality disorders, teen violence, suicidal ideation and behavioral issues in her assessment of this case. Actually, many of these areas have been touched on during the four month trial, in looking at both Jodi Arias and Travis Alexander's behavior.

If you recall, back on February 6 of this year DeMarte's Phoenix home was broken into and among the items that were stolen was her laptop computer that contained her psychological report on Jodi Arias. Detectives called the break-in "suspicious", given that DeMarte has been identified as the State's expert witness in publicly filed documents for more than two years, although they stopped short of saying it was Arias-related. Mighty suspicious, or is it just another coincidence?  It would seem that the State would have had to provide a copy of DeMarte's report to the defense ahead of time, although I'm not familiar enough with procedures around discovery items to say when they would have received it.

What will Dr. DeMarte have to say about murder defendant Jodi Arias? How much will her report differ from Dr. Richard Samuels or Alyce LaViolette's? Among DeMarte's listed specialties are trauma and PTSD (these are the areas Dr. Samuels testified about), but she may be able to effectively challenge both defense experts opinions. I believe the State would have chosen the best expert they could retain and I don't expect Martinez to disappoint! It must have been extremely painful for the Alexander siblings to sit in that court room for the last two weeks and hear Alyce LaViolette and Jennifer Willmott deconstruct their brother's character and his morals. Given that neither of them ever met Travis Alexander, it has angered and outraged many court watchers to hear the levels to which the defense team has gone to paint Travis as a bad guy.

Blaming the victim has been a defense tool and tactic that has been used in trials all across the country. It's nothing new. But the LEVEL that it has been used in this trial seems excessive and people are finding it offensive. Isn't it possible that Jodi Arias will say anything she has to in order to avoid Death Row? Why is that so hard for Alyce LaViolette to believe? Given what Arias stands to lose if found guilty of first degree murder as charged, wouldn't common sense tell you it was possible she was not being truthful about these alleged incidents? The Alexander family has shown great strength and restraint in the courtroom. Hearing lies being told about their murdered brother for the last three months, and not being able to show any reaction or grief must be extremely difficult and frustrating. All I can say to them is stay strong, the State's rebuttal case is coming. And know that many many people who are viewing this trial do not believe Jodi Arias's description of your brother. We all are so sorry about the death of your brother Travis.

What will next week bring? The trial lost another juror last week, goodbye Juror #11. Alyce LaViolette was reportedly taken to the ER for anxiety and palpitations last weekend and was photographed sharing a meal with Jennifer Willmott & the death penalty mitigation attorney. Despite my opinion about LaViolette's testimony I don't wish her any ill health. I'd never buy anything written by her after this trial, nor would I seek her out as a therapist if I needed one, but I certainly don't want bad things to happen to her. I'll just be happy to see her heading for Sky Harbor Airport and heading back to Long Beach.  Will Jodi Arias's tweets spark a war with Nancy Grace and the HLN team? Will Matt McCartney betray Arias by telling the truth about the alleged abuse, the gun and the secret magazine codes? Will Kirk Nurmi get a blazer that better fits the length of his arms? Will Arias sketch a portrait of Judge Stephens and auction it off on her website? Anything is possible in this trial! Have a fantastic weekend everyone.

    7. I find it irritating that people use "forensics" to establish credibility of an expert and then turn around and say the other expert didn't interview Travis. DUH. He is dead. This expert can't interview him either. That is why it is called forensics. The prosecutor didn't interview Travis, neither did the crime scene crew nor the detectives...he was and is dead. They are ALL piecing things together. Please stop that ridiculous argument.

As an attorney and former clinical psychologist I was sorely disappointed in the testimony of Dr. Samuels, although I was happy, as a pro-prosecution fan, that he self-destructed, and was just plain outraged by the testimony of Alyce LaViolette.

I, too, am looking forward to hearing from a published clinical psychologist who has conducted scientific and statistically-based research. And since she is Juan Martinez's witness, I can only assume that she will appear unbiased, and will answer questions directly and concisely, irrespective of who's asking the questions.

    1. Opal Bailey,
It's very telling that an attorney and former clinical psychologist such as yourself was outraged by LaViolette's portrayals of Jodi Arias and Travis Alexander in this case! I hope that after seeing how uncooperative and combative the last expert came across on the stand, Ms. DeMarte will respond respectfully and completely to both the prosecution AND the defense attorney. This will be a refreshing change of pace. The jury has to be getting frustrated with the back & forth confrontations they have endured lately. Unprofessional to say the least. Thanks so much for your comments!

    2. Opal: refreshing to read of your experience & wonder if you've encountered defendants or patients like Jodi, in your practice. You must be tearing your hair out, when you hear such fabrications. I posted back to you (I'm the TAXI DRIVER reference) & wonder what you make of professionals, drawing conclusions w/o supporting facts, incomplete data, & a diary written by a Cluster B person. The credibility of their assumptions is less than the Cliff's Notes version of a Dostoyevsky novel. Frightening, when the testimony has potentially devastating consequences for more victims like Travis & his family. Again, my heart aches for them, every time I see their faces, as the tv camera pans the gallery. I would expect an expert to explain the how's & why's, but not excuse or justify it, as ALV & Samuels seemed to do, regarding Jodi.

      Delete
    3. Anon: No, I did not encounter patents like Jodi when I was a clinical psychologist because I worked primarily in state psychiatric hospitals and outpatient settings where the most common diagnoses were schizophrenia, major depression, manic-depressive disorder, and psychosis or serious mental illness related to organic brain syndrome (includes a gamut of diseases), sometimes complicated by another diagnosis such as a developmental disability. So while many of my patients had criminal histories, I did not typically deal with antisocial personalities or other character disorders. I would say that most of what I know about the antisocial personality, which, in my rusty and humble opinion is what Jodi is, comes from my many decades of life experience, my being a true crime and murder/serial killer mystery buff who has read a lot about sociopaths and watched a lot of true crime television and investigation shows, and -- I hate to say it but it's true -- my having spent over 30 years in my beloved former home of New York City! So I cannot claim, these days, to have anything over the average person who is obsessively interested in understanding how criminals think. I share your view of the defense expert witnesses's credibility, and your heartache for Travis and his family. Witnesses like Dr. Samuels and Ms. LaViolette do nothing but feed the skepticism and disparagement of their respective disciplines by the public-at-large, and reinforce the notion that psychology is just a lot of mumbo jumbo that can be spun to try to help even an obvious, remorseless, cold-blooded killer escape punishment for her crime.

    4. Opal Bailey,
Great reply to Anonymous. I don't know what type of personality orders Arias may have, if any - but from the first time I saw her speaking in one of her jailhouse media interviews I got a very bad vibe about her. Sometimes our gut feelings are so accurate yet they lack any scientific significance. Great to hear your perspective on Arias and the trial. Thanks for posting!

    5. My Forte & Opal: thank-you both for posts & commentary. I, too love a good mystery/true crime story. I used to be a crime fiction fan, until, like my aforementioned post, true crime struck my family. After those trials, my interest in true crime took over & I never read fiction again. At the one trial, the perp actually defended himself. It was a repulsive, repugnant & vile spectacle. When I read Jodi wanted to represent herself, I was nauseated. All I could think of was the brutality she'd continue to inflict on Travis' family, as if she hadn't already done enough. I still think she has all aspects of Cluster B, not just antisocial, borderline & narcissistic. I find she also displays histrionic characteristics: excessive emotional instability & attention seeking, shifting & shallow emotions, over attention to her looks, seeking immediate gratification (she even wrote this on her MySpace page), impressionistic speech (& specifically her journal writings) & viewing relationships as more important/intimate than they really are. I also wonder how her "experts," knowing she hacked into Travis' phone & computer, didn't think to question if all of those writings were even the product of Travis, himself. After all, Travis did question Jodi if she'd been using his phone & we know e-mails were sent to new girlfriends. Some of the flowery language that Travis supposedly typed to her in an e-mail just ring false. In one, he said he wanted to be her "muse" & other such- & I use this term loosely- poetry. This just reeks of Jodi. She was constantly sneaking into his house (her laptop or phone in hand, I'm sure), to send phony messages between them- possibly to "expose" him to potential girlfriends. When you hear him on the sex tape, there's no poetry there... just a normal 30yr old guy's blunt & basic urges. I also wonder if she had sent that surreptitiously recorded sex tape to Travis' boss, bishop or Mimi, prompting that final "you are the worst thing that's happened to me" text, precipitating the gun burglary & events of June 4. Another thing I found odd is why Juan Martinez kept asking her what Travis shouted at her, after she shot him. The Med Examiner was not a forensic pathologist. There's a difference. The Med Examiner is usually an MD elected or applies to post & has a specialty in some other area of medicine- like internal medicine (as in my town), & does initial exam/autopsy report. A forensic pathologist has received a fellowship in this specific area. IMO, if the bullet traveled through the right frontal lobe to left, then lodged in his left cheek, it may have pierced the Broca's Area (a bit further in & to the left) which is the speech-selection section of the brain. This would prove her statements false, as he would've been unable to shout, "I'll f#% kin' kill you, bi#% h!" Really hope pathologist was able to determine this, even w/ advanced state of decomp. I'm not looking forward to anymore from this defense team. They could be employed by the Obama Administration's drone program- boring the enemy to death...droning on & on & on.

      Delete
    6. Based on Dr. Horn's clinical findings and testimony, it's only logical to conclude the bullet to the brain was rendered post mortem. If you listen carefully to her statements when interviewed by detective Flores, the knife and gun was used to make it appear as if the assult was the workings of two perpetrators. However, the body continues to make gasping sounds after death and I assume in her panic she shot him to "finish" him off. But let's not forget the bullet wound lacked hemmoragic activity and the casing landed on top of a large pool of blood. Neither of which indicate the gunshot came first. Forensics aside, from a statistical standpoint, less than 5% of all gunshot wounds to the head are survivable. The tumbling of the bullet and the expansive gasses in the brain cause immediate neurological shock so the liklihood of him being able not only to get up, but to actually speak is less than zero.

      Delete
    7. Yes, anonymous @ 11:33, that's why I found it impossible if the bullet pierced the Broca's Area, regarding her statements that he was shouting anything. However, MaryJo Buttafuco was shot point blank in the head & bullet lodged over right ear & she lived. I also had a case where someone had been shot in the face & bullet went from right cheek, exiting through lower left jaw area & not only survived, but told his attacker, "I'm already dying. Don't shoot me again." With a small caliber bullet, such as a .22, .25 (in this case), or even a .38 (as w/ the woman in Georgia, who shot her attacker 5 out of 6 times at close range, to protect her 9yr old twins; attacker was able to not only flee the scene, but drive 50 feet in his car), it could be deflected or "bounce around" skull, missing vital brain areas. I do agree that she probably heard the "death rattle" or other sounds related to expiration- which is just horrific in & of itself, knowing the degree this poor man suffered- & she did panic & shoot, finishing him off so he'd be silent before the roommate came home. I struggled w/ the "why not the gunshot 1st" theory, as the casing could've been lodged in her clothing & fallen out during the clean up. I've had shell casings eject & land behind the lens of my safety glasses, causing a slight burn mark on my right cheek- where the frame touches the face- while at the gun range. The casing would've bounced upon hitting the tile floor & could land on congealed blood. Doesn't really matter which came 1st, as both scenarios are equally vicious, cruel & not self defense. My thinking is that Juan Martinez is very smart & knows things we don't. I believe he would have to know something about Jodi's order of events being completely false, to go w/ the stabbing 1st. There's a shower pic that looks like something flat, thin & shiny, is at the bottom of the frame. I'm wondering if he enlarged the photo, as he did w/ pic of Jodi & her sister revealing the unbroken finger- almost foreshadowing things to come- & it will show she was holding the knife while taking those pics. Now that would be tremendous!

      Delete
    8. Should read, "Woman in Georgia, who shot her attacker IN THE FACE, 5 out of 6 shots at close range, to protect her 9yr old twins..." Sorry, I was typing too fast.

      Delete
    9. Yes, roughly 5% of gunshots to the brain are survivable. Not 100% fatal 100% of the time but *generally speaking*, neurological shock is immediate and death follows before 1st aid can be rendered. My motto has always been "the exception proves the rule". The lack of hemmoraging in the skull and around the entrance of the bullet wound is highly suggestive of lack of blood flow to the head. His defensive wounds to the hands are an indicator of purposeful activity and the blood spatter in the bathroom doesnt suggest an "average" shooting took place there. While anything is possible, I think it's improbable the casing was somehow hung up in her clothing for any length of time. All factors considered, it's obvious to me the gunshot came last. And the sequence does matter which is why the prosecution disputed her version with such conviction. Gunshot last goes to establish "aggravating circumstances of a cruel and heinous nature" making the Murder 1 charge eligible for the death penalty, which is what the state is seeking. Gunshot first all but eliminates the death penalty as premed alone doesn't usually qualify for the DP and securing it is far more difficult. Ps.. I believe she had the knife hidden behind her back and after she got him to sit down, she convinced him to close his eyes for a specific pose. That's when she came in and rendered the first stab to his chest.

      Delete
    10. Actually, the state charged Murder 1 w/ 3 factors: cruel, depraved & heinous, but were only able to get cruel (at least one is needed). Don't ask me why, as it certainly seems all 3 would apply. I agree stabbing came 1st & think Travis thought she had left his house for Utah & he jumped in the shower (as those beginning pics look unposed & taken through closed shower door; then a sort of surprised look on Travis' face photo when he turned to her). I do believe she had the knife on her person (maybe the same one she slashed Travis' & girlfriends tires) not one of his kitchen knives (or there'd be chips from nicking skull & other bones on one of those found in dishwasher- they didn't look like Wusthof knives!). Decomp was such that findings weren't definitive, that's why I'd really like to know the path through frontal lobe, 'cause that would totally disprove her story. She may have just held the gun on him, so he'd do as commanded & she was able to stab him in the chest (maybe recreating that story she had heard so many times; the one he told on the sofa to his group of friends & at speaking engagements) & shot him as he tried to get away from her stabbing. Did anyone notice Jodi was wearing the black flip-flops she left at the crime scene (in evidence photos) during the Chicken Dance Video, shown on HLN? Eerie.

      Delete
    11. Oh, & like I commented on this sites' "something about the broken finger" post (I'm the anon. on April 13, 2am) Jodi may have planned this as a murder/suicide (stabbing Travis & shooting herself) but covered her tracks before & after, just in case she "chickened out, like a little b#tch" like she said during Flores' 2nd interrogation tape. It's a possibility.

      Delete
    12. Sorry, I typed wrong info: Arizona has 14 aggravating factors, & the state charged her w/ #6 cruel, heinous & depraved & #13 cold, calculated manner but only one, #6 was ruled a factor in this case, but I think both would apply.

  17. I'm a little worried about this expert. I believe she has phenomenal credentials, being able to testify in regards to both DV and PTSD and do real testing but she lacks the yrs of experience. Then again the 2 'experts' for the defense have 60+yrs and they proved that this meant very little. She's young, has obviously earned her degrees and experience with the latest education/technology and not in the infancy of some of this stuff so really looking forward to her discrediting the 2 amigos even further.

If she testifies that Jodi is as we believe a lying psycho killer, why would the defense have even tried to put on their experts? I realize they don't have to prove anything and if they can convince even one person of reasonable doubt they have done their job but JM did a great job showing the bias and outright lack of professionalism from the DT's experts. These DT experts ended up helping the state and probably putting the final nail....

On her website she states her rate which I believe is less than $200 per hr. This will only matter if she shows a lack of fairness and tries to avoid questions. That for me was ALV's issue, not the fact that she never swayed from her beliefs. Amazing about the theft of her laptop, coincidence?

Yes, you are correct in stating that DeMarte does not have a lengthy career. I believe I read that she has been practicing for 8 years? If she is able to provide a more well balanced and fair assessment of both Jodi Arias and Travis Alexander she will have done her job better than the defense experts. Dr. Samuels lost credibility by failing to retest Arias for PTSD after finding out she was lying about 6/4/08. Instead of admitting the error, he argued it wouldn't effect the test results because trauma is trauma? That may make sense, but it still leaves the jury feeling like he took short cuts and was sloppy. LaViolette was simply too over-the-top biased against the murder victim, without talking to family or friends and big mistake to take Arias at her word on every single detail! If DeMarte comes across as thorough and unbiased, I think that will make up for her tenure vs. the defense experts. Thanks for your comments! Go Juan Martinez

    3. My Forte, my understanding is that Alyce Laviolette could not speak to Travis Alexander's family. That has been at issue because she apparently approached one of the sisters and told her something to the effect that it "wasn't personal." It surely has seemed personal the way she has trashed Travis and even said that Jodi was NOT the perpetrator of the greatest violence. But at any rate, my understanding is that any defense witness would be barred from speaking to members of the victim's family.

  18. Was she scheduled to see jodi that day and hodi was able to let one of her 'gang' that her house would be empty? Same a Bobbie Juarez, shortly after Travis was killed, Bobbie Juarez was murdered getting into his car one morning to go to work. Someone walked up and shot him, ran back to a waiting car, witnesses describe as a tan coloured Cadillac, and it remains unsolved. I heard I don't know where, that hodi had asked him to provide her with an alibi for June 4th and he said no. I wouldn't be surprised to connect hodi and probably matt maccartny to this murder.

    2. momsboy,
I don't believe this is the same Robert/Bobbie Juarez that Jodi Arias was with because of his age when he was killed. The unsolved murder that happened on 7/10/08 in San Diego was a Bobbie Juarez who would have been around 21 years old in 2008. His MySpace page has a photo of his headstone, bday and date of death are listed as 12/22/87 - 7/10/08. He was married and had a young son. It doesn't sound like the same ex boyfriend of Arias but I could be wrong!

    7. Anonymous - RE: multiple questions relating to Bobbie Juarez unsolved murder on 7/10/08. There is much confusion around if this is the same Bobbie Juarez who previously dated Arias. The Robert Angel Juarez who was shot in front of his house while leaving for work was married and had a young son. A MySpace page maintained by his friends/family lists his birthday as 12/27/87 and actually lists his death as 03/05/08. Is this him? http://www.myspace.com/rip_bobbyy/friends This seems like a common name. It appears the one I'm referring to is not the same Bobbie. I don't believe he was married or had a child and this Bobbie would have been 21 at the time of his death. Others have stated THE Bobbie Juarez is indeed alive. Not sure how to confirm this but one of the photos listed in NancyB post above was reportedly taken in 2012? The only thing I do know is there is an unsolved murder involving a Bobbie Juarez in San Diego who was shot by someone who ran to a waiting light colored Cadillac. The gunman and driver were reportedly hispanic. Anybody know for certain? Thank you!

    8. The Bobby murdered is no relation to this case or Jodi Arias. Her Bobby is Robert Joseph Juarez and he is in fact living in Hawaii. His ex girlfriend has a youtube video that you can access by googling "Bobby Juarez Jodi Arias abuse" and/or "same bobby juarez" .. something along those lines. He is an actor and it is definitely the same Bobby. A crime Blogger on twitter verified it and the photos match..

    1. Hi Anon! I understand why you would think this but a forensic psychologist's discipline includes the training and expertise in all realms of the scoring and administration of tests and are always used in forensic court cases. Sometimes I have seen a forensic psychiatrist also testify in conjunction with a PhD psychologist.

In this case, a psychiatrist to prescribe and manage medication is a non issue. There is little evidence that conventional counseling will have any impact on these individuals and often makes them worse.

I will be excited to see if DeMarte gave JA the MMPI. As others here have surmised it would be difficult to imagine that she is anything other than a ASPD-P. The P is for psychopath, which I'm strongly in belief that she is even though it is currently not a diagnosis in the DSM.

It will make all the difference in the world if she is clearly searching for the truth and not taking sides. It's OK to say that Travis Alexander had flaws, who doesn't? It's just so unbelievable for an expert who spent no time searching for the truth to claim Arias told the truth about every single detail about the relationship and the murder. Very inflexible. Bring on the rebuttal case. I'd love to see Matt McCartney get on the stand and tell the truth, the whole truth and nothing but the truth. Arias could have very well lied to him too though. 2. I believe that Juan has already impeached ALV on numerous occasions during his cross of her testiphony. The suspense of why the judge has mandated her court appearance on Tues is an interesting puzzle. The best that I have worked out is that she may be admonished in some way but I have nothing solid to base that on. I highly doubt that she would be charged with perjury. Juan has showed her to be a biased and untruthful witness. Many people lie under oath and it is rarely if ever charged. The last thing that Juan or Judge Stephens want is a mistrial. If ALV's testiphony was completely thrown out by the judge that would finally give the defense a valid motion for mistrial.

Maybe it has something to do with contempt of court: There’s more at the link below.

"A direct contempt is an act that occurs in the presence of the court and is intended to embarrass or engender disrespect for the court. Shouting in the courtroom or refusing to answer questions for a judge or attorney under oath is a direct contempt."

    1. Hey Anon! You said: "Not legally insane, just scary cra-cra." So true!

I too have believed for a long time that she is drawing in court. I'm continually aggravated that she is allowed to do it while in open court! I noticed that the court guard was monitoring her more closely last week. It's about time. When the trial 1st began the guard positioned himself either directly behind her or to her side while standing. For the last 2 months I have seen the 2 guards on the opposite side of the courtroom from her, which is nuts. I've also seen one of guards in repose that resembles nodding off. The week before last when JA asked for a bathroom break and the judge gave her 3 minutes, I saw her waltz through the door totally unaccompanied by anyone. That's just bizarre.

    2. I've been wondering the same thing re: the drawing in court because I've noticed she does a lot of erasing. It doesn't look like she's erasing just a word but some part of a drawing. This Professor Says…Don’t Waste Your Money, April 5, 2013
    By LifeProf
This review is from: It Could Happen To Anyone: Why Battered Women Stay (Paperback)
As a professor, author, and researcher in intimate relationships and sexuality, I feel qualified to assess LaViolette’s book.

While some of her discussions are accurate, the difficulty lies in the fact that her thoughts and ideas are left over from the 1970s and are from a radical feminism framework (which is fine for those who adhere to that ideology); in full disclosure, ethical researchers and scholars typically discuss their paradigm (bias), but LaViolette does not.

This is important to note, because the radical feminist framework always holds the male accountable for the violence, and holds women innocent; this is in direct contrast with what current research studies indicate. While empirical evidence does indicate that women are typically the victims and men are the perpetrators, this is NOT ALWAYS the case. LaViolette’s book fails to note that men are battered, too

Other problems exist in the research cited in the book–most of her research is QUITE antiquated, dating back as far as the 1950s. This is unfortunate as it does not truly represent what we know about Intimate Partner Violence (IPV) and Domestic Violence (DV) in our culture today; the research is not current, it is not relevant, and it is NOT representative of the landscape of IPV.

Furthermore, LaViolette’s interpretation of some of the benchmark studies is skewed. I suspect this is due, in part, to her lack of research experience. After all, she is a clinician, not a researcher. This is evident in her writings.
I knew of LaViolette’s work prior to the now-famous murder trial of Travis Alexander and because of her lack of research knowledge chose not to cite her in any of my books.

Now that I have watched her testify and have seen how she grossly misrepresents Walker’s Cycle of Abuse, I question her knowledge of IPV and DV and her relevancy in today’s culture.

  41. My Forte - In response to a comment you made on the previous thread. You wondered if the defense team was reading any on line blogs and comments. YES. I definitely believe that they are. The defense team for CA publicly stated after the trial that they were. They had hired a media consultant team to do this on a daily basis. Baez credited the copious amount of intel that they were obtained from these activities as instrumental in crafting their trial strategy at different periods during the trial. Why I definitely believe that this defense team is also involved in similar and intensive on line reading has to do with a few recent "planted" media reports. One of those surfaced at the same time that the defense filed one of the latest motions to dismiss & prosecutorial misconduct against Juan & the picture taking claims. The defense was claiming that they were receiving death threats and they required security teams to safely egress entry and exit to the courthouse! Maricopa County Sheriff's office announced that there have not been any death threats their office is aware of and that they were not supplying any security details to the defense or anyone else involved with the trial.

Some ladies who attend court on a daily basis and support Travis' family happened to be standing outside of the front entry of the courthouse after court had ended for the day. This was 2 days after the defense had planted these claims through Michael Keifer's first duplicitous article. They observed Nurmi & Maria (mitigation specialist) waltzing out the front doors of the court bldg and leisurely walking passed all the MEDIA trucks. Nurmi even stopped to make some comments at one of the trucks. They were alone. NO security or details accompanied them. The ladies took a few pictures proving this with time & date stamps. They are media saavy and knowledgeable about how to glean and use on line forum opinions to their benefit.

Thanks for posting this info. The defense continues to cry foul regarding the media, yet their client is blantantly tweeting and taunting the media from her jail pod/cell. I suspect she's made more money from behind bars than she did in the free world, with her sketches and through donations made on her art website and the other website that supports her and her famiy. Meanwhile, the Alexander family has to sit stoiacly and hear people tear their brother apart. It's not fair. I wonder if JM will be able to bring up the topic of online art auctions and tweeting in this case? Arias is using her notoriety for personal gain. Do these behaviors support a remorseful human being? Let the jury decide! Thanks NancyB!

  43. Early Friday morning I saw a package (a long one) on CNN while I was getting ready to leave for an appointment. Ahleigh Banfield had on Jean Casarez along with a panel of 4 attorneys. The topic was based on the so-called digital lynch mob. Poor Alyce being “followed” to that restaurant a few nights ago (where that picture was taken of her with JW and Maria having dinner.) The article by Michael Keifer referenced claims of harassment and intimidation of a witness etc. I was so angry at these disingenuous and devious false claims that were the central and only focus of the piece. It was a very unbalanced one-sided segment.

Several people who have been in court on a daily basis have reported the following statements on this issue:

“Laviolette, DelaRosa and Willmott waltzed in to the Palomar for dinner last night. Of all the restaurants near the court, they go to the one where ALL the media stay and where we go for our Happy Hours after court. I call that BAITING."

“Because they made a big stink about having their photo snapped at Pei Wei. So what do they do? They go where they KNOW they will be seen together instead of avoiding it or not eating together and leaving themselves open to speculation. It’s blatant.”

“Supposedly she goes in to the ER last weekend w/ anxiety over this stress she’s feeling and instead of getting Chinese takeout, going to her hotel, bringing her to your house, ordering a pizza, finding a small hole in the wall restaurant near your house, making her a peanut butter sandwich, they choose to walk directly in to the hornet’s nest. This was deliberate and I think this DT is setting up all kinds of circumstances to go for a mistrial.”

There is a PATTERN (ha!!!) regarding ALV: First she’s sick and court is canceled; then she goes to ER and we hear about it in the media (making a record if it? – usually that’s a private thing); then there’s a mistrial motion that references the stress she’s endured; then there’s a significant media story about it, in the middle of her testimony; then she’s photographed in a known media hangout almost as if she was placed there for that purpose; then she tells the judge, Friday, that she can’t be back to court on Monday because she’s having more “tests.” She felt the need to say that while the cameras were on her. Probably more stress” tests. There’s the record, all ready for the motion…

According to Keifer’s latest article this week, apparently ALV thinks she’s being stalked and harassed. So why walk right in to the hornet’s nest? Why not choose a restaurant, any other restaurant in the entire city of Phoenix that does not revolve around this trial?

There is absolutely NO proof whatsoever that ALV was followed to the restaurant where her picture was taken. None.

The reaction of the public is not mob mentality and I’m sick of that fallacy being promoted through the media by her defense team. There is no evidence of witness intimidation. None. The media pundits fail to note that our ire has been stimulated by ALV’s hypocrisy in taking this case to vouch for this psychopathic and premeditated killer and in actively supporting the defense of her actions being justified by the blatantly false shield of being a victim of a terroristic domestic violence.

I am disappointed that our viewpoint has been given NO media air time. I just wish that a true victim of DV/IPV would have had the opportunity to be a part of such a package/segment on CNN. It is a huge disservice to the facts of this case to not have the import of ALV’s biased and paid for testimony challenged by an extremely reputable voice that speaks the truth on this very important issue.

This was just the latest of the defense's paid for media stunts to skew opinion and get a mistrial.

  46. WOW Breaking NEWS: Hope this is true. I found it at The State vs Jodi Arias Facebook page:

Jeannie Dalrymple posted to Alyce Laviolette

I wrote an e-mail to Corporate Alliance to end Partner Violence regarding my concerns about Alyce LaViolette and learned that they have cut ties with her, and she is no longer part of their organization!

If you want confirmation of this, I will forward you the e-mail I received from them.

Here is the letter I wrote:

    To: caepv@caepv.org
    Subject: Alyce LaViolette

I am just wondering how your organization can align itself with Alyce LaViolette in light of her recent unprofessional and biased testimony in the Jodi Arias trial.

It is one thing to testify for the defense; I don’t have a problem with that. The problem I have is that she has absolutely TRASHED the real victim in this case, Travis Alexander. She never met Mr. Alexander or talked with his family or friends. She took the word of an admitted liar and cherry-picked e-mail texts and messages out of context and labeled him a perpetrator! She explained away any of Ms. Arias’ behavior as “to be expected” because she is a “victim” yet any of Travis’ words are considered to be “evidence” to her that he was an abuser. She repeatedly referred to Mr. Alexander as a “liar” because he told family and friends he was a virgin even though he was sexually active, yet said that Ms. Arias was NOT a liar, even though she has lied repeatedly for nearly five years, and gave two different stories about what had happened to the victim before coming up with her “domestic abuse/self-defense” story once her defense attorneys got involved.

How does Ms. LaViolette sleep at night? Watching the Alexander family suffer in court due to Ms. LaViolette’s completely unwarranted character assassination of the ONLY victim in this crime is heart-wrenching, and it keeps ME up at night. I wonder if Ms. LaViolette has any more of a conscience than Ms. Arias.

Ms. LaViolette’s testimony will make it much harder in the future for REAL victims of domestic violence to ever be believed in court. She has betrayed the very people she claimed to care about and devote her life to.

How do you align yourselves with a woman who has turned her back on true victims of domestic violence and murdered the victim once again in court? Is this what your organization stands for?

Here is the response I received from:

“Thank you for your email. Alyce LaViolette is no longer affiliated with our organization.”

    1. I have mixed feelings about this. While I don't find LaViolette's testimony to be credible, there are some factors which the general public isn't completely aware of such as: she wasn't *allowed* to talk to family and friends of Travis Alexander as part of her clinical findings in this case. I think her testimony was fundamentally flawed and biased but this is what happens in courtrooms across the country every day in America. She is a witness for the defense. Honestly, her opinion isn't going to make or break the prosecution's case. The defense is legally obligated to provide their client with individuals who will mitigate/testify on their behalf. This is not news. If we are being fair and honest here, folks should be more outraged at Richard Samuels who falsified test results to benefit Jodi Arias! Talk about UNETHICAL AND ILLEGAL! No doubt LaViolette underestimated the backlash and public interest in this case but I don't agree with online petitions to end her career and personal attacks/ threats against her. Death threats are never warranted and Amazon shouldnt allow angry trial watchers rate her book that they've never read on the Amazon website. It's not appropriate or justified. She needs to be held accountable in the courtroom - not in my livingroom or anyone elses. It seems to me she has done many good things on behalf of vicitms of DV spanning 3 decades and while the decision to allign herself with the defendant / defense in this case wasn't a wise one, she really doesn't deserve the social media lynching which she's currently being subjected to. I hate when folks participate in cyber hysteria resulting in someone being tried and executed in the court of public opinion. There's nothing savory or justifed about it.

    2. Absolutely untrue that she was not *allowed* to speak with other witnesses. As for her testimony that she wasn't allowed to interview Travis' family that is a LIE. If the defense had *wanted* ALV to conduct those interviews all they had to do was make that request through the prosecutor's office and it would have been arranged with him present. The family would not have objected and that came straight from them! ALV most certainly had the opportunity to have told the defense team that unless she was allowed to have access to all of the case information (like any reputable forensic expert) that she would not take the case. Eleven other forensic experts had turned the case down prior to them contacting ALV. She made her decision and now it is completely fair game for people to express their ire for her duplicitous and biased conduct in this case along with her arrogant and disrespectful behavior on cross. I also thought it was very unprofessional for her to offer unsolicited testimony to the jurors that her pension fund was poorly funded...before Juan cut her off with an objection which the judge sustained. Please do not talk about non existent death threats. There is no credible information to support such a statement. We can agree to disagree on how much good she has done. Crystal Harris (google her name) was viciously beaten and raped by her husband and was finally able to change laws in San Diego surrounding her case. Her husband was sentenced to 6 yrs in prison and is currently serving his sentence. She just finished taping a Dateline segment that will air in June. She maintains that Alyce's classes for the perps (men) were not just worthless but repeatedly caused her husband's violence to escalate and that many women have had the same experience. See what Dr Kristina Randle has to say on the subject.

    3. NancyB & Anonymous (4/14/13 at 8:33PM), That's definitely newsworthy info, Corporate Alliance To End Partner Violence is no longer affiliated with Alyce LaViolette. It feels like many people are sympathizing with LaViolette over the public backlash over her testimony in this case. I suspect it isn't her professional opinion, but rather the liberties & assumptions she took in coming to her absolute conclusions that Travis Alexander was a liar and Jodi Arias was truthful. I thought I heard Juan Martinez state that nothing was stopping her from speaking to any of those "vulnerable" women that Travis was in contact with. I'm not sure he would have said that if she was in fact limited in who she could contact. As with Richard Samuels, it just feels like LaViolette didn't try to seek out enough sources on Travis's side and relied too heavily on a woman who is literally now fighting for her life and has a history of lying. It's outrageous that ALV sees patterns with Travis Alexander yet ignored the pattern of lying with Arias and explained them away as either occurring when she was a teenager or when she was afraid of the consequences of the truth. It didn't even seem to matter that Arias lied to LaViolette. That is what is so disturbing about her testimony. Thanks for writing!

    4. Her testimony was indeed flawed, biased, unprofessional and downright disgraceful. I do not disagree and think criticism (as it relates to said testimony) is fair and justified. What I disagree with are the personal attacks she's being subjected to as well as the online petitions to end her career in public speaking. I disagree with over 1100 people using Amazon's book review as a forum to attack and defame her over a book MOST have never even read. It is insane the amount of venom being spewed at this woman. This is witness intimidation if ever there was a case. How unfortunate it would be if a mistrial was declared because of it. I'd say from a legal standpoint the defense could make a damn good argument, especially since this cyber lynching has sent their main witness to the ER.

      Delete
    5. The reason for the personal attacks are because of ms. Laviolettes unsubstantiated personal attacks on Travis..she is attacking his character without facts and solely on the word of a lying psychopath...she did shoddy work and does not deserve to be called an expert..

  47. I tend to agree with this last (anonymous) opinion. LaViolette may have made a mistake taking on this case to begin with and will no doubt regret it at some point, especially in light of the character assassination taking place on Amazon, the petitions against her, etc. So, in a sense, she's already suffered for her poor choice in the court of public opinion. I don't believe the Prosecution's case hangs on her testimony, insomuch as Juan Martinzez has discredited it. I believe it's time to look forward, hope and pray for the best as Martinez produces his witnesses. I think a more fitting psychological profile will emerge for Jodi at that time, and it won't be a pretty one, God knows. Thanks to this site, we at least know who one of the expert witnesses is. I can't wait to find out who else he puts on the stand. Let's get this thing moving!

Agreed, let's move forward to the next witness. I don't know if Alyce LaViolette realized she may be staking her career on this case, but now that she's made her $250-$300/hour bed she has to sleep in it. I tend to agree that this case doesn't necessarily hinge on the expert opinions as much as the overwhelming amount of evidence of forethought and coverup of the murder. Let's hope that common sense prevails in the jury deliberation room!

  48. I saw a complete list of Dr. DeMarte's research studies about a month ago, but cannot find it again and have gone cross-eyed trying to do so. But here are some links to research studies/papers/publications she did or co-authored. Check out the titles, and relate them to the Jodi Arias trial. I think that we have good reason to be optimistic about her testimony! Here's hoping!

    1. Opal Bailey,
Thank you for posting this info! Will check it out. I think we are all just hoping for a more BALANCED assessment of this relationship. The last three months have been all about Jodi Arias the victim, not Jodi Arias the killer. I'd be interested in hearing what DeMarte says about Arias's profile.

  50. Alyce, was just a ploy.. for the DT to steer everyone away from the real Victim Travis. She
was hired to sway the jury to Arais side and
that's it, with all the testimony for wks. & wks.
Juan needs to bring it home, the real reason, the
brutal murder of a young man, by a cold cunning
young woman. Lets face it DT didn't have a case to begin with, Nurmi wanted off the case too. It's been to long.. I'm praying that justice will be served.

I think you are right about Nurmi. He seems almost disinterested in court since he sat down after questioning Arias for a month. His posture says it all. He was originally assigned to this case back with the original public defender who asked to be removed. His specialty is defending people accused of sex crimes, he must know a lot about pedophiles and the like. You can almost see how the defense was "born"! Thanks for posting.

  51. I pray this expert can bring out the truth. some are saying jody is fighting for her life, I don't believe she thinks she is. also, just a bit of humor next motion for mistrial-it's not fair they got the good expert and we couldn't find one.

    1. Jody certainly doesn't appear to be fighting for her life! Off and on Tuesday I observed her busily writing SOMETHING.
I wondered if she was playing tic-tac-toe or doodling. I'd really like to know. For someone with a brain like Einstein's, I don't know how she can look so laid back!

  52. looked her up in superpages. It shows she is 32 but then another entry shows 47. Either way she is more credible than Alyce L.

  56. I think Jodi is getting on wilmotts nerves...she is constantly nudging her to tell wilmott something and is acting like she is smarter than her own lawyers...i bet she is working on her MANIFESTO in court..she is writing like a nut...its just another reason to hate that lying psychopath..

  57. Amateurish witness. 8 years does not an expert make. If I were on the jury considering putting a young woman to death, I would expect a much more experienced expert witness.

  58. Dr.Demarte you are amazing, you are very professional and you sure know your profession. I think you are very qualified and very well spoken. You are very articulate and again it shows your knowledge on this field.

  59. Ms. Demarte
I just want to applaud you for your testimony in Jodie Arias' murder trial. You have done such a professional job in testifying unlike Dr. Samuels, and Alyce whatever her last name is. Your professionalism is a breath of fresh air FINALLY A DR. WHO UNDERSTANDS HER STUFF. JODI IS GUILTY AND your doing GREAT FOR THE PROSECUTION.

  60. I don't understand why dr demarte never administered a PTSD test why she didn't test Jodi for it. Why is she including her schooling experience in her years of experience and why she is not an expert in Domestic Violence. Her testimony today did not make me feel good.

    1. she cannot do the test again because once it is done the person has an idea what the questions are and this will invalidate the second test..

  61. I think that the witness has proved that she is not qualified to make the statements she has. The defense has shown that Dr Demarte is not as credible as Alyce.

  64. Let's CLEAR matters:
First, DeMarte DOES NOT look like Jodie. Jodie DOES NOT look like DeMarte. Second, DeMarte is NOT pretty. Jodie IS. Third, BOTH DeMarte and Jodie know how to lie. Fourth, it DOES NOT matter if you hate Jodie or if you dislike ANYONE involved in this trial because the JURY will make the FINAL decision and they will be merciful. You and I are influenced from the media to be hateful, repulsive and distasteful, especially from NANCY UNGRACEFUL, I mean, Nancy Grace. See what I mean?

  65. Just so everybody is clear...you cannot give a person the same psychological test twice..you can re evaluate the answers like janeen did but once the test is given the person knows what the questions are like and can manipulate the test...this is why janeen did not give the ptsd test again..

  69. Dr Demarte reminds me of the medical examiner, Dr. Horn. Both testifying with straight, smart answers and no circular logic or anecdotes. I wondered with Dr. Horn what JW was getting at with the whole bullet passing through the brain questioning and the sequence of injuries. She kept trying to imply that Dr.H directly told Det Flores that the bullet wound happened first. I wonder if a "rumor" was somehow circulated to that affect so that JA would match her new story to the false forensic evidence, i.e. she shot Travis first. That way Dr.H would be able to completely invalidate her account by stating the fact that it was medically impossible for the shot to come first and that he never spoke with Det Flores. So JW regroups and tries say DH can't be sure the bullet passed through the front of the brain and of course he told her it definitely did pass through the brain and would immediately incapacitate TA. I think this might have been a tactic knowing JA was going to try to create a plausible story around the forensic evidence!

I loved it when JW sarcastically asked Dr.D if she wants to go back to whole expert thing and Dr. D says, "Sure!" LOL I keep laughing every time JW tries to corner her and Dr. D just calmly says nope... denied! Dr. D is just too smart to get caught with cheap tactics and it's very clear that she knows these tests inside and out along with the protocol and how and why every aspect should evaluated. I think it's very clear to all of us that there is something off with JA and the diagnosis of BPD makes it clear how she could have done everything she's done.

The jury only gets to see what is factual AND non-prejudicial. So for example, JA (in an unheard of move) a couple of years ago approached the DA's office to plead guilty to 2nd degree and 25 years. It is factual but if the jury heard it they would look at all the evidence with the idea already that she's guilty. Even though they are not seeing all the stuff we see, I think JM has pretty much decimated the defense. Although it's been tedious to listen to the defense we have to let them examine all possibilities so that when they come back with guilty it's proper. If they didn't do their jobs we could end up putting to death someone who was actually innocent or acting in self defense. JW and KN are just doing their jobs making JW proove beyond a shadow of a doubt that JA is guilty of premeditated murder.

I want to mention that I think Judge Stephens is doing a great job! No easy task! She is really working hard to allow both sides to present their cases, avoiding a mistrial and appeals issues. I have a lot of respect for JS!

Shocking that laptop was stolen but just another twist in this bizarre case!
